It's so sad that X17 is so happy that the conservatorship may be removed. She will be hospitalized or within 3 days of its removal. With her father involved, Britney has been forced to get help and behave. Even her hair looks halfway decent for the first time in months. X17, do you mean, "Removed TO federal court?" It is unlikely that will happen. If it does, though, it does not void the state court proceedings. It just grants the federal court jurisdiction. If it is removed to federal court, no doubt it will be bounced back to state court promptly.

The Federal Court will throw it right back to the LA district.

The federal courts would only rule whether Britney's constitutional rights were violated, not who would be the conservator.
Jaime allowing britney to teach children undermines his case that she can't take care of her own affairs.
It also makes him liable if any of the children are harmed. Britney, it was reported, tried to pick up some random children after she lost custody. What would happen if she barricaded herself with a child in the bathroom of Millenium studios? If Jaime is convinced that she is not going to barricade herself, then why does she need a conservatorship?

People...just for your information, this is not how it works. If the so called "filing" passes thru, a hearing is set. (Meaning a date will be chosen). Motions will then be filed. Should the motions go forward, then a date will be set for arguments. A judge at that point (which is riduculous to assume that it would go that far) will then most likely deny the removal of conservatorship....NOT BEFORE THIS HAPPENS. This filing means nothing in the short term....this would take weeks or months to have the conservatorship removed.....actually....maybe this would be a good thing...

This actually will lengthen the time for Jamie to be conservator because nothing will change until the thing is looked at and considered and then bounced back to the state so, in theory, Jamie will have even more time to straighten her out while Sam wastes taxpayers' money for nothing.

State Court May Have Lost Britney Jurisdiction

It's the craziest thing we've ever heard, but it's probable the State court has lost jurisdiction in the Britney Spears conservatorship case.

Sources at the L.A. County Superior Court tell TMZ, "It's possible jurisdiction has shifted to the U.S. Federal District Court." How, you ask? Well yesterday, a lawyer filed legal papers in federal court asking a judge to seize control of the conservatorship case on grounds Britney was at great risk in the L.A. County Court system.

The sources say just by filing the paperwork, the federal court probably has obtained jurisdiction. We know that sounds bizarre, but legal experts tell us that is indeed what has happened.

A well-placed source in the L.A. County Court system says even if the federal court has jurisdiction, they believe the conservatorship and all orders are still in effect, but no further orders can be made or modified unless and until a federal judge kicks it back to the state.

Crazy, Crazy, Crazy. Stay tuned.

A federal Judge will look at the case and instantly give it back to California. If he's in a bad mood then he may take action against the people(lutfi &x17) who filed the complaint.

"This is nothing new," says Bryan Spears. "This was a decision made some time ago and signed off on by Britney, before she was married to Kevin, before she had kids. As with anyone with a large trust, trustees were named. This is nothing new."
So what does it mean to be a trustee? Bryan and Taback have the power to pay for Britney's "continued security, medicine, food, other day-to-day expenses and for psychiatric and other medical services," according to court documents. Neither party can act unilaterally, but require "unanimous consent" with the other trustees to act. The documents also state that the trustees can't sell or lease Britney's home without a court order, nor can they remove any of Britney's property from California.
The trustee appointments were made a week after conservatorship attorneys were granted the right to fire Britney's business manager, Howard Grossman.

I fail to see how her rights are being violated simply because she is bored. Living her life in a nondestructive way is a good thing to me. This whole thing smells like bullshit.

Frankly I don't think it really matters WHAT happens. Either way, Shitney will come undone and die an untimely death. It will happen sooner than later if she is left on her own. Jamie as conservator will only delay the inevitable.

It wasn't the State of Calif. who declared Britney gravely disabled. It was her own psychiatrist.

Britney's medication is being dispensed, not controlled, by a 3rd party because it was probably determined that she was incompetent to assume the responsibility. This often happens in cases of severe brain damage and also the elderly. One does not need to be a RN or LPN in order to qualify to do this. When available, home settings are preferable to institutional settings.

The courts have already provided Britney with legal representation, and again - this does not rise to the level which would require habeas corpus.

None of us knows her true condition. She hasn't even been fully evaluated yet. Can we not just sit back & let these people do their best for her instead of running around saying, "It could happen to you"? Conspiracy theories have no business in the middle of this. However, after that Britney had to be examined by not one but TWO mental health professionals -- both of whom had to be employed by or under contract to the Director of Mental Health for the County of Los Angeles, acting in his capacity as "Community Health Director." So, it was not her own psychiatrist who declared her gravely disabled, it had to be the County of Los Angeles.

Federal courts don't have jurisdiction over conservatorship matters and there is no legitimate federal question raised by these pleadings. Therefore, the most a federal judge will do is send the matter back to state court. In the meantime, the state conservatorship will continue to function.

In other words, this is just sound and fury signifying nothing. The only thing that's going on is a waste of time and money.

I suppose the pertinent question should be whether Britney wants to see Sam. She's been home several weeks now. Does she want to see Sam & Alli? But Public Inormation Office says that's not the case, telling PageSix.com, "This has no bearing on either the pending probate case or custody case that we are aware of."

Sands maintains that Eardley has been hired as Britney's lawyer, but the commissioner in the conservatorship case ruled earlier this month that the 26-year-old was not mentally capable of retaining counsel.

Driving while on speed (here I'm referring to Adderall, not meth) is almost the perfect task. I loved the focus and attention required. I would watch cars turn into and out of roads, the signals, the traffic lights, the colors, the curves of the road, the sensations of the car, etc. My psychology class, though already my favorite class, was even more intriguing this time around. I watched my professor constantly, almost as if I were alone and I were being tutored--this information was exclusively being revealed solely to me. Law enforcement sources tell us the Major Crimes Division of the LAPD is on the case. The conservators have complained that Lutfi drugged Spears as a way of keeping her under his control. We're told the investigation is very much active.

Lutfi could not be reached for comment, however, Michael Sands, Lutfi's spokesperson, tells TMZ he is aware of the investigation.

Any case can be "removed" from state court to federal court with the very simple filing of a paper, which acts almost automatically; but "remand" back to the state court occurs most of the time; either on the filing of a motion for remand or on the federal court's own initiative. Conservatorship, guardancy, etc. is exclusively a state court matter and it is not likely that a federal court would, or could, exert jurisdiction.

Superior Court yesterday in which lawyer Jon Eardley asked that Britney Spears' conservatorship and custody cases be moved to the Federal courts, the Superior Court's Public Information Office has released a statement that reads, "It is our view that all current orders in this matter remain in full force and effect."

Michael Sands, a publicist who has most recently been linked to Britney's former pal and manager, Sam Lutfi, told PageSix.com today that the papers filed yesterday would negate both the conservatorship (in which Britney's father, Jamie, was given control over her finances and medical care), and the 21-day restraining order against Lutfi.

But Public Inormation Office says that's not the case, telling PageSix.com, "This has no bearing on either the pending probate case or custody case that we are aware of."

Sands maintains that Eardley has been hired as Britney's lawyer, but the commissioner in the conservatorship case ruled earlier this month that the 26-year-old was not mentally capable of retaining counsel.

SIMPLE! If the Feds get involved, things that we never expected may occur. The most important being the investigative capability of the Federal Government. Man, you all are stupid. "Removal" is a legal term of art which only means a CASE is removed FROM state to federal court. No orders are removed. It has nothing to do with any of that. And, it won't be removed anyway.

Her father is an ex drunk with no business or medical experience yet he has absolute authority over her.

The moment the papers were filed in Federal Court, the state had no jurisdiction to rule on anything. The only way the state can be involved again is if the federal court after examining the removal refuse to take jurisdiction.
