LOS ANGELES—Kevin Federline's attorney complained in court that Britney Spears has repeatedly failed to respond to calls for court-ordered drug tests.
Federline attorney Mark Vincent Kaplan told Superior Court Commissioner Scott Gordon Thursday that there have been 14 laboratory requests for drug testing and Spears failed to respond to eight of them.

Federline has temporary custody of Sean Preston, 2, and Jayden James, 1, because Spears has defied court orders.

Kaplan told Gordon, "Mr. Federline doesn't want to take the children out of their mom's life, but we don't know what else there is to do."

Federline and Spears were not in court for the hearing.

Spears lawyer Anne Kiley argued the previous court order was unconstitutional and Spears didn't respond to the lab phone calls within an hour, as ordered by the court, because she was sleeping.

Kiley asked that Spears be given six hours to respond to the laboratory phone requests.

But Gordon said time wasn't the problem, noting Spears had lost telephone numbers and changed her telephone numbers. The commissioner then noted he has to wake up at 7:30 a.m. each morning.

Kiley interrupted: "You're not a pop star with a No. 1 album."

Gordon suggested Spears get a separate cell phone for lab-only use.

Kiley then said she wanted to contact the laboratory, and Gordon said lawyers should reconvene at 10:30 a.m. with a plan that works.

UPDATE: Both sides came back to court and told the judge they had not yet reached an agreement. They said they needed more time to talk and will present a complete plan to the court by Tuesday at Noon.

The Commish did not change the current visitation order, so everything remains as he ordered on October 26. One item he did order: Brit must notify her lawyer immediately when she changes her cell phone number. Apparently, she changes her number as often as she changes her clothes, and he's over it! He told her attorney that she must then immediately contact Kevin's lawyer, and then call the drug testing facility. That's some phone tree!

The judge told her lawyer, "Basically, the testing facility needs a number they can call and get a response."

They'll be back in court on November 26.

Britney Spears has been routinely ducking court-ordered drug tests, a lawyer for ex-husband Kevin Federline said in court Thursday.

Spears has been called to the laboratory 14 times, but has failed to respond to eight of those calls, Federline attorney Mark Vincent Kaplan told Superior Court Commissioner Scott Gordon Thursday morning.

"Mr. Federline doesn't want to take the children out of their mom's life," Kaplan told Gordon, "but we don't know what else there is to do."

Spears lawyer Anne Kiley argued the previous court order was unconstitutional and Spears didn't respond to the lab phone calls within an hour, as ordered by the court, because she was sleeping. Kiley asked that Spears be given six hours to respond to the laboratory phone requests.

Gordon said time wasn't the problem, noting Spears has lost telephone numbers and changed her telephone numbers. The commissioner then noted he has to wake up at 7:30 a.m. each morning.

Kiley interrupted: "You're not a pop star with a No. 1 album."

Gordon suggested Spears get a separate cell phone for lab-only use.

Kiley then said she wanted to contact the laboratory, and Gordon said lawyers should reconvene at 10:30 a.m. with a plan that works.

She didn't fail the drug tests. Kaplan is saying she didn't RETURN the phone call within one hour, not that she didn't do the test. Britney's lawyers are saying she shouldn't have to call the drug facility back within a hour but she will get the test done under the 6 hour period. Sounds fair, and I'm sure the judge will agree to that.

My guess is she will end up killing herself or a drug overdose, of course with her legs spread open showing her puss for the last shot!!
