It makes A LOT of sense. Civil rights laws are Federal -- and Britney's civil rights are being violated:
- Incarcerated
- Money and possessions taken away
- Not allowed freedom of movement
- Not allowed to see or even talk on the phone to whomever she wants

Both custody and probate conservatorship are state court actions. The federal courts don't have jurisdiction. If it is a matter of violating her federal constitutional rights, she (not Lufti) should file that action in federal court. There is no legal basis for removal from state court to federal court in this matter. IF and when Sam shedules a hearing on it the Judge will read it -- and deny it in about 38 seconds -- just enough to call the case, take appearances of counsel and rule in the matter as a matter of law.

Crazy New Legal Papers in Britney Case

In a bizarre twist, a lawyer in NYC has filed legal papers in Federal court, asking that Britney's conservatorship case be taken away from L.A. County Superior Court.

In the documents obtained by TMZ, attorney Jon Eardley claims Britney's rights have been snatched away from her and she has been cut off from life as she knows it.

Eardley claims, "It is doubtful that Ms. Spears can receive equal protection and a fair trial or hearing in the custody proceedings because of the intense media scrutiny of what would normally be private aspects of a person's life." It appears Eardley wants an injunction issued in federal court, asking the judge for the power to protect Brit in the custody case as well.

The documents allege "the deprivation of her civil liberties by the conservator is so severe as to interfere with the effectiveness of the scheduled medications that are covered by the Food, Drug, and Cosmetics Act." This appears to be an attempt to get the Federal court to accept jurisdiction.

It is unclear on whose behalf Eardley is acting. We're told Sam Lutfi and his publicist, Michael Sands, have something to do with the filing, though the exact nature of their involvement is unclear.

As a Paralegal for 15 years, I have to agree that this case will not go far, if anywhere at all. These parties would have to prove gross negligence on the part of the local court, and it seems that they have been very careful in all of the pleadings I have read, to have parties appear for Britney- even in the hospital. Bottom line is, she doesn't have to agree with them- but they HAVE been there to assure that her rights are not violated. In situations like these, you have to remember that any attorney who can get themselves recognized as a party in the case can start the billing process and the court will authorize it. Basically, you can start running a tab as soon as the court agrees to hear you. It creates a pretty nice payday scenario, so it probably wasn't hard for Sam and Michael Sands to talk this guys into filing this paperwork. Federal civil rights ARE a big deal, but the express powers of a conservatorship legally include the powers that Jamie has been given. He isn't violating anything. Also, the fact that she was out there not only endangering herself, but other motorists and people in the public places she was running around in will weigh in with the court IF they consider this (which they don't have to). I am sure there are lots of local officials who will offer testimony that the situation is much safer for all involved. In all my years in this field, I also haven't seen verbage that amounts to "she can't call her friends". That just sounds immature and whiny. Britney can appeal a final order through the California court system. Nobody can circumvent the California courts by filing a petition in federal court. That's a whole new case. The federal courts may not put a hold on the California courts. They don't have that power and they know it -- not even for gross negligence. States and Judges have immunity.
