Britney Spears' former manager, Sam Lutfi, is calling the pop star to testify in the upcoming hearing for his 2009 defamation lawsuit against Brit and her parents.

Papers filed by Lutfi ask that the judge require Britney's conservators to make her available to testify in court with her role as a judge on the upcoming season of X Factor as proof that she's capable to do so.

In 2009, Lutfi claimed breach of contract and defamation against Spears and her parents Jamie and Lynne and the case is set to be tried in court this month. He claims Britney breached a contract that would give Lutfi a portion of the star's fortune AND that her parents made defamatory statements, alleging Lutfi drugged Britney and cut off her phone service to isolate her from her family.

Spears' conservators have claimed she's not mentally competent to testify, but her $15 million contract to appear on Simon Cowell's talent show doesn't help their argument. Lutfi even submitted a DVD of the X Factor teasers as evidence the star is fit to speak on her own behalf.

A hearing is scheduled for September 25 and a judge has yet to rule on the request.

The soon-to-be Mrs. Timberlake looks stunning even after a flight yesterday when she touched down at LAX. The actress wore baby-blue jeans, a lace-detailed blouse and grey cardigan and ballet flats for the plane trip ... and she looked anything but plain!

The actress returned from Puerto Rico where she visited fiance Justin Timberlake on the set of his upcoming movie "Runner, Runner.

But Jess isn't letting her own career slide while she attends to her boyfriend ... she's got her own movie, The Tall Man, which just hit theaters. It starts out as a thriller and evolves into a sociological horror film. While critics haven't been too kind to the film, they're overwhelmingly in support of Biel's acting in the movie. The LA Times' Mark Olsen, for example, says that while Biel hasn't quite found her niche, she "tones down her striking beauty and athletic curves to believably play a desperate mother with disheveled hair and minimal makeup." He goes on to describe the film with less favorable words: "But the story sends her hurtling through a world gone weird, where conspiracies pile on top of one another until the narrative spins out of control."

Seal decided to drop a BOMB on photographers when he landed at LAX last night ... he surprised them by telling them EXACTLY what he thinks about "rumors" his estranged wife Heidi Klum has been hooking up with her bodyguard.

In a completely unexpected move, a guy who is normally silent and sometimes combative with the paparazzi, Seal decided to unload and vent to photographers, giving them the "answer that you've been looking for for the past seven months" and here it is ...

A paparazzi videographer is shopping a tape that X17 has viewed, in which Seal tells the paps the following:

"Look boys, that's what happens when two people separate. They move on and that generally means [they have] other people in their lives. I necessarily don't expect to Heidi to all of a sudden become a nun, but as always, my main priority is the emotional well being of our children."

We started slowly so now for the payoff ... here's Seal's JUICIEST statement:

"To be quite honest, if there is going to be somebody else in their lives, I'd much rather it was a familiar face. I guess the only thing I would have preferred is that ... I guess I didn't expect any better from him, I would have preferred Heidi show a little bit more class and at least wait until we separated first before deciding to fornicate with the help, as it were. But I guess you now all have the answer that you've been looking for for the past seven months."

Klum filed for divorce in April. The couple have three kids together - Henry, 6, Johan 5, and Lou, 2 -- and Heidi has daughter Leni, 8, from a previous relationship.

During a recent trip to Sardinia, Italy, Klum was photographed in intimate situations with her bodyguard and X17 has video of Heidi, the kids, and her bodyguard, returning from that trip back to LA on the 28th. Klum went out to dinner at BOA the following evening, without her hunky bodyguard ...
