Jon Gosselin is going after primary custody of the eight children that he shares with Kate Gosselin, according to his attorney Anthony F. List.

Kate's ex filed the papers in a Pennsylvania courthouse today. In regards to the filing, List tells X17online exclusively:

"She is no longer the final arbitrator when it comes to the kids. Her position as the final arbitrator ended at approximately 3 o'clock (EST) when these documents were filed. When Kate Gosselin went back to LA for Dancing With the Stars, Jon called her right away and said look, I'll move in. I'll watch the kids while your gone. Kate said no."

Jon is also asking the Pennsylvania courts to review the couple's current child support order - which forces him to pay $20,000 a month. List says, "It's ridiculous. It's contrary to the law in Pennsylvania. I don't think Donald Trump could pay that kind of support!"

As for Kate's parenting skills, List tells X17online:

"I don't find any fault with her lifestyle, just her parenting. That's what I'm concered with as Jon's lawyer. Hollywood has had too much influence on the decisions she's made as a mother. It's a lifestyle that's a very unique one. But it's a problem when she starts using the children because she's angry with Jon. Putting a gym in her home to practice dancing doesn't make her a good parent. She is where she is today because of those eight children."

List expects the custody case to resume within the next two weeks.

Eva Longoria dishes to Ryan Seacrest on KIIS FM that she recalls an on-set incident between Desperate Housewives' creator Marc Cherry and Nicollette Sheridan.

While at KIIS to promote her charity Homes For Haiti, Eva tells Ryan:

"I know they did have a thing on set. I guess it was couple years ago. It was so long ago, the actual incident ... and I wasn't on set when it happened, but apparently this incident happened and she felt it was, you know, wrong."

On Monday, 46-year-old Sheridan filed a lawsuit against Housewives creator, Marc Cherry, accusing him of hitting her in the face.

Eva adds that the incident was "regarding them doing a scene and something like, he was showing her how to do a scene....I really would like all of it to go away!"

As for her thoughts on Marc Cherry, Eva says:

"He's funny and sweet and probably could not harm a fly. He's just so sweet."

Eva says that she hasn't spoken to Nicollette since the actress left the hit show in early 2009, but adds, "Nicollette is a sweet girl, too. I'm really confused about this whole thing."

Sounds like an expensive case of he said/she said!

Jess talks about her beauty tricks and how she's the girl next door, but she shared one dirty little secret about her hair that totally shocked us. She tells the mag:

"If I'm in a mood to go out and feel hot and sexy, I want long hair that I can feel on my back. But I also like bed head ... I'll usually wash my hair and let it air-dry wavy, but if I'm just in a hang-out mood, I won't even wash it. I'll wait until it smells."
