A photographer says he was nowhere near Madonna when the pop icon took a nasty spill off a horse in the Hamptons this weekend - and even the local cops are backing him up!!!

Thomas Hinton tells the New York Daily News that he snapped Madge on her horse around 3:50 in the afternoon and then left the area. He headed back to property where Madonna was staying when he received a tip there had been an accident.

"I arrived more than 10 minutes after she fell and I was shooting from the street," Hinton said.

Madonna's spokesperson Liz Rosenberg had claimed that the singer's horse was spooked when a paparazzi jumped out of the bushes. Why couldn't she just say she fell???

After the mishap, the 50-year-old Madge was taken to the hospital and checked out, but was released a few hours later.

Our girl headed to the Blue Table in Calabasas with her (HOT) new bodyguard Saturday between shows in LA and Anaheim, and our photog tells us, "She was very tight lipped and seemed to stay close to her bodyguard. I think she was still rattled over the stalker incident."

The R&B diva headed to MyHouse over the weekend with several bodyguards, and used the garage and back entrance instead of making an entrance as we've seen her do in the past.
