The high-powered firm of Trope and Trope filed legal papers today asking to withdraw as Brit's hired guns in her custody dispute with K-Daddy.

In the legal papers, attorney Tara Scott from Trope and Trope wrote, "There has been a breakdown in communications between [Britney] and Trope and Trope making further representation of her interests impossible." Ding dang wha?!

No word on whether Brit has a new lawyer.

TMZ has learned Britney Spears' deposition was scheduled today and she didn't show -- again!

If we're counting correctly, this is the fifth time her scheduled deposition in the custody case didn't happen. Last month, Britney claimed she was too ill to sit for her depo, yet TMZ caught her out partying that same night.

Sources say the fact that she didn't show for the depo was a factor in her lawyers' decision to file papers today asking to withdraw as counsel, but it was only one of many reasons. As one connected source put it, "Her whole life has become insane and it's impossible for anyone to get through to her."

I for one love EA's posts. I believe them to be genuine not only with the facts, but with heartfelt sincerity as well. I have been reading the posts tonight and I have to add, I don't know who EA is, I haven't been coming to this site for very long, so I'll just go with the assumption that she does in fact know Kevin. Its nice that she is being supportive to her friend. However, in my opinion, and it is just that, MY opinion, I wouldn't bother letting him know what people online are saying. Here's why: First of all, it appears to me that Kevin has done some growing and maturing over the course of the last year. Whether this is due to his attorney's suggestions, his parenting classes, or any therapy he is receiving, I don't know. Or perhaps, it is due to the natural maturation process. Whatever it is, I hope that it is really happening and not a facade. Which brings me to why I wouldn't bother bringing him outside opinions. The only opinions that should matter to Kevin are his own, his childrens', his family's, his attorney's, and his friends. Even his friends' opinions are on the outside edge of importance. Although the public feels like it should have a voice in these matters, in reality, none of us do or should. And for every positive that is brought to Kevin, in the back of his mind, he knows that there are others that have been filtered out. I know most will disagree with me, I am just stating MY opinion.

I think Kevin Federline's lawyer has dropped the ball if he does not immediately seek an end to this case by petitioning the court for a default judgment ruling. Depositions are not only a legally mandated discovery process in civil court cases, Britney's deposition is also her defense declaration under oath. At this point the ball is in Britney's court but she forfeits the game if she refuses to serve. If she refuses to defend her case she can lose her case by default.

Britney Spears's latest lawyer, Sorrell Trope, filed a request Wednesday to withdraw from the singer's custody case, court documents show.

"There has been a breakdown in communications between (Spears) and Trope & Trope (law firm) making further representation of her interests impossible," says the document.

Trope gave no further details. But he told PEOPLE the ultimate decision to quit isn't up to him.

"A lawyer cannot simply withdraw from a case," he says. "We will ask the court to relieve us." A hearing is set for Feb. 4.

That will be followed by a hearing for Spears and Kevin Federline in the custody case on Feb. 19.

Trope was Spears's third lawyer in her ongoing battle with her ex-husband.

Her first attorney, Laura Wasser, resigned from her case in September shortly after Spears's divorce from Federline was finalized.

Spears then hired the firm Freid & Goldsman, but their relationship ended within days.

Trope faced an uphill legal battle in the Spears case. Shortly after his firm took over, the singer temporarily lost custody of her sons, Preston, 2, and Jayden, 1.

While she did regain her visitation rights, Trope's tenure has been fraught with setbacks, including Spears missing numerous drug-testing calls, her skipping of a deposition due to an alleged illness, and her questionable driving skills.

You are so right about those boys not coming back here to read about their mother, or anywhere else for that matter. In reality, they will end up handling this the way that most other children of mentally ill parents do, especially if they have one stable and loving parent. They will look back most likely with sadness and acceptance that this is who their mother is due to the illness she has. (Supposedly it runs in the family, parental grandmother also had mental health issues), so those boys will need to be watched and hopefully intervention will come early if there are any signs/symptoms for them. Its a sad thing, but not uncommon. The only real difference is that this is playing out in such a public forum.

I am a Kevin supporter and I do disagree, but I do read your posts and realize you are a smart person. I do respect your opinion.
I think the support has helped Kevin. I think for the first time he realizes that people respect him for being a dad. He had a rough time career wise, and I think it's made him grow as a person to see that being a dad is one thing he is really good at. I do believe he loves those kids and they are first in his life. I have done a lot of research on Kevin and I think he is misjudged. I have read articles and quotes from way back, and his values are pretty clear. I admit he has made mistakes. He was young and did foolish things, but we all have. It seems to me he has grown from those mistakes and learned. Sadly, Britney has not. BTW I also have been here awhile and EA is real. I get what you are saying, and having never been in that position, I can't speak from experience. But Kevin doesn't seem to be as hated now as he was when he was married to Britney. I think a lot of people have started to see him as the grown up in that relationship. If he was able to withstand what he had to put up with back then, at this point, I would imagine those people's opinions wouldn't make a rat's ass bit of difference, even if those opinions are now positive. But again, thats just me. I truly wish him and those boys nothing but the best. My husband met SP when he was about 5 months old and provided some security for Britney/SP when Britney felt that she was being harassed by the paps. He said SP was adorable. (Our own son is just 2 months younger). He didn't have nice things to say about her though, and this was back before the shit hit the fan so to speak.

Does it come down to Kaplan filing something to that effect? Or is this one for the Commish only to judge on?
