Britney Spears' 'Lawyer' Ejected From Courtroom After Judge Doesn't Recognize Him As Her Counsel

The battle over Britney Spears' affairs heated up in court on Monday (February 4) as her father and his lawyers faced off against a new attorney who claimed to have been hired by the singer this weekend. The lawyer wanted to fire the singer's father as conservator of her estate, though the court ultimately did not recognize him as her counsel.
Streisand, who said he was referred to the singer by her custody lawyers at Trope and Trope, had also questioned the expertise of court-appointed co-conservator Andrew Wallet, claiming that he didn't have the expertise to handle the estate or the trust, given that Britney's estate is worth $40 million, encompasses 15 separate entities and is in the middle of a $17 million audit. Streisand had asked the court to instead name Northern Trust Bank and Spears' business manager Howard Grossman as co-conservators. Whether or not Brit TRULY requested Streisand may not be known for awhile. What should be of concern is that she cannot hire ANYONE without the permission of the conservators. In plain English she cannot do anything that her dad does not agree with. Conservatorship or total control? As much as I am THRILLED that she is being "contained" it does seem troublesome that she cannot even express her desires (in this case legally) without her father's permission. Whether or not she is truly capable of understanding what she is asking of others is another question. So... who was this guy...the court investigator as he was called. Is that his job .. is that what he did? Showed up to tell Britney what was what. Apparently he only spent 15 minutes with her. Now a court doctor will be told to go in and evaluate her and determine if she can make heads or tails of hwat is going on. They are to report back to the Judge on the 13 and another hearing will be heldon the 14th.

The thing this brings up is... Britney must have some kind of will? A good attorney would likely have asked her this question and have it on a document.. who is to care for her estate if she is incapacitated in any way? The court-appointed attorney would have had a limited visit with Britney due to her fragile state. When someone is diagnosed as Gravely Disabled, they're not capable of holding a business meeting.

I've had my son committed twice, but he was willing to go, so I can't tell you much about unvoluntary. I can tell you about the Psyche Units. They are not some horrible place you think about in the movies. Yes, they do have some patients like Britney that are severe, but they are well treated in most places. They do have rooms (They call them quiet rooms) where they can calm down if they get upset and sometimes they are medicated or restrained. The last time my son was actually hit by another patient, so it does happen, but usually it's just people like himself that have gotten off their meds or relapsed. They have different levels. Acute is for the severe and then as they progress they get more freedom. They have a day room for TV, they can smoke at certain times, etc. It's not pleasant but it's nothing anyone couldn't go through. After all is said and done, if she gets well, her stay will be well worth it and she can hopefully return to her life. Most people who have to return will relapse or stop their meds. It is a never ending battle.

Sam came after the VMA's. He was around for the Video and she did a great job on that. If Britney doesn't want to do something she is NOT doing it. It took a shrink and 30 cops to get her into the hospital.

If she is bi-polar as they say and can love and hate the same people in an hour time frame, that certainly says to me her comprehension/ability levels may change from hour to hour also. Just seems a little too frightening that she has absolutely no rights until February 14, a pretty damn long time period if you ask me. What would technically happen if she is fully detoxed in the next day or two and more "rational" but no one will speak to her or hear her because her father has the power to keep them out. Just really glad that is not me in this situation. And for the person who brought up Alzheimers and/or Dementia; Yes, I have been there with an in-law but she was DIAGNOSED. As far as we know, Brit has no official diagnosis yet that would warrant such "seclusion" from help.

Under 5270.55, Britney can be involuntarily held an additional 30 days AFTER the 14 day period if medical professionals deem it necessary. It can go on and on. And even after she's released to assisted outpatient treatment, her status can be revoked should the physicians deem it necessary. This is going to be a lifelong thing. I think her fans expect that she'll just pop out of the hospital one day all "cured".

Also, due to the Gravely Disabled diagnosis, Britney now has been entered in the State's Mental Health Firearms Prohibition Database. The Baretta will have to be sold. She can no longer possess a firearm.

As time passes, I think people will gain a clearer understanding of what's going on, and the severity of the situation. At least I hope they do.

Today's hearing involved much more than the testimony of the court-appointed lawyer. His testimony was just a "layer" so to speak. Other issues which were included were various medical reports and other testimony.

It was a "preponderance of the evidence" which led to today's ruling. No one thing or person made this happen.

I have a difficult time with anyone who tries to separate someone from their family. That's typically a maneuver used by control freaks who abuse their victims - either physically or emotionally - or both.

Just because Sam allowed Britney to yell at him in public doesn't mean that he doesn't employ other tactics to control her. Apparently there was enough evidence against Sam that the courts ruled him a danger to her health.

Chicago. Thanks, my son is doing better. He has schizoaffective disorder, which is a fancy name, but it really means a little bit of all of it. We have been in and out of hospitals for a very long time, and I have to agree that 2 weeks will probably not be enough time for Britney. I could go on and on about what we have been through, but everyone is different. As someone said earlier, mental illness is a hard thing to grasp. It's not like a knee injury where you have an operation and then recoop. This tends to come back. I think the Spears family has a long road ahead and I wish them the best. I'm sure they are all going through hell right now. I know we sure have. It's so hard to watch your child suffer and there is really nothing you can do. My prayers go out to all of them.

I assume that you have probably grieved over your son's diagnosis. As a parent, I can't imagine that when your son was little you had hopes and dreams for him, and a life with a mental illness never entered the picture. It must have been heartbreaking when you received the news. The realization that life would never be "normal" for your son or your family. No matter how well controlled his illness is, its probably always in the back of your mind that things can change in an instance. I know I am making a lot of assumptions, and I apologize if I am wrong about any of this. I also do not mean to infer that your son does not have a meaningful life. I am sure that he probably does. I am just hoping that others here will stop and think about the far reaching effects that a mental illness can have not only on the person with the disease, but also everyone around them.

Britney's parents did not do this. Her psychiatrist did. It was her psychiatrist who call the police & arranged for her commitment.

People please - it is NOT easy in America to have someone involuntarily committed. Stop & think about how many medical malpractice lawsuits there would be if it were.

Britney's father is only in this position for 14 days. It's up on Valentines Day, if I remember correctly. At the time, the court will re-assess the situation.

It's simple. She's not in her right mind and if someone doesn't make the right decisions for her, she is going to harm herself or someone else and be taken advantage of further.
If this didn't happen and she did end up harming someone people would be on the band wagon upset because no one did anything. There are laws intact for people who clearly can not function and make sane decisions to protect them pure and simple.
There areactually many states in fact where you can become award of the state and not released unless a family member consents to take care of you. So actualy, she's very lucky she is not in one of those states and that her father is desperately trying to help her. Even in a drug or alcohol intervention they generally recommend cutting off inances when the addictrefuses to get help in order to protect them and force them to get the help they need. If they don't have money to access they can't generally run away from cleaning up very long. This isn't very different from the norm. She has to have everything stripped from her so she can sit and finally be forced to get the help she clearly needs. Mental illness can hit anyone but getting help when you are this severely mental should never be a choice. You can't make a choice when you are not in your right mind.

I don't understand why it took so long for them to finally decide that she is Bipolar. Many people that are aware of the symptoms have been saying it for months and months. She was a classic case that has now reached *severe* Pretty sad.

When I was Britney's age. I was being verbally and physically abused by not only my boyfriend but my BOSS. I tried to commtt suicide and after coming out of the coma I volunarily went into the psych ward...

My doctor never bothered to show up the whole bloody time. Another doctor came to me and said you have not seen your doctor do you want a doctor? And I said sure and you can be my doctor.

The next night I find out my dog is in the pound and I get permission to leave with my friend to go get him. When I get there it is closed. So I phone the hospital and I say I will come back the next morning, my friend is with me and then I can get the dog out before I go back to the hospital. They say ok. Three minutes later a cop shows up at the door and I am handcuffed and now being committed against my will for trying to escape! I am stripped of my clothing and thrown in a padded cell for three days... it was a long weekend. It fucked me up and I would NOT talk. On the Moday after the holiday the shrink chats with me and I am let back into a normal room.

The psych ward was a terrible place to be. People were screaming in the middle of the night. Everybody was a stranger just doing their job. You had to eat on a little school desk and were chained to it untill they put you back in the padded room. I did't even have anything to read. A mattress on the floor and a pillow. You didn't even get a blanket!!! I was treated like a criminal.

At one point an inmate gives me a book. I am back in a regular room and doing the sessions. This one girl says she was gang raped. She is the one screaming her head off at night and the one that gave me the book. One day I am with my boyfriend visiting. She sees him and freaks. Thn a shrink talks with me and tells me that she thinks my boyfriend is one of the guys that gang raped her. And I say like hell... he has done shitty things but he didn't do that... andthe shrink is really pressing it. I go back to my room a day later I am reading the book.. and guess what the exact same rape scene she is describing in one of her sessions is in the BOOK! So I take it to the shrink... and show her... she is pissed and snarky with me. I figured this girl could not tell us what really happened to her and she was using the story as a cover... but her subconscous wanted to tell the truth so she... picked me to tell her story.. it is not acoincidence that I am the one she gave the book to and then freaked about my boyfriend...

So the psych ward sucks big time.. hope Britney can go somewhere beautiful with a fulltime staff of medical people to help her recove... the sych ward can fuck you up wors.. but I survived.. :-)

I am glad that I can be supportive to you. Its easy to lose sight of how many other people are effected by someone's disease when all you see if the chaos surrounding that one person. But so many others are just as effected. As a parent, I can't imagine what a sense of loss and fear, anger, denial, all the different stages of grief. I don't need to tell you. I imagine you must go through them to some extent everytime your son is hospitalized. Maybe not as intensely as the first time, but still, those feelings must still linger.

Here is what I believe JS, its not much, but it gets me through - everything happens for a reason. We may not always know the reason, but we have to have faith that there is a reason. That and a little bit of dark humor get me through. I'll get off my soapbox now....

If I may interject myself into the manic conversation...manic episodes do not always equate to extreme happiness. Some people have ended up killing themselves when manic because they believe that they are incapable of feeling pain therefore they can fly out of 10 story windows. (Just one example). Manic episodes can also manifest as extreme irritability. It is also observable as behavior as manic people tend to do things such as excessive shopping, inappropriate sexual behavior (think of the white shirt that Britney wore to the mall), basically any extreme behavior.

Its not just the moods that make this disease so notable, the behaviors really are the attention getters.

Earlier today we were discussing this bipolar diagnosis. To be frank, I don't trust Lynne Spears & the spin she puts on everything. Another poster brought in another disorder with symptoms which could also fit Britney. A neighbor of ours is a psychiatrist & I had called her the other day for her take on the situation. Like most of the others, she said it would be impossible to diagnose Britney without several sessions, but she did offer several options to the type of behavior.

Also to note, my youngest son is bipolar - which I had not mentioned. His behavior during his cycles before he was diagnosed were very different from what I've seen in Britney. I really don't see any happiness in this girl at all - let alone euphoria.

I don't know if we'll ever find out exactly what Britney's diagnosis is. We're all guessing really. I just think we can converse without starting up the name calling or the high school crap.

Luckily she can afford the best and should employ the best. Once on the right meds, she could be stable and perform and even be a mother again. But only if she realizes that not taking her meds will result in disaster.

Instigator, thanks for your kind words. He's doing pretty good, thanks. My (enabler) ex-husband & I battled for years. He was in denial that anything was wrong with our son. He was a classic "Disney Dad". There were times I literally wished my ex dead. It was out of frustration & trying to get help for our son. We get along better now though.

I started watching this out of concern for Britney's children. I was pretty disgusted with Britney's behavior, but as she grew more & more incompetent I wondered if something were really wrong. I mean, she was Dirty for pete's sake. She looked like she wasn't bathing or caring about herself.

I'm relieved that they have her where she's at. At least they can try to get her in a place in her head where she wants to help herself. Those boys need their mom to be as healthy as she can be.

Oh my goodness! The guy was hired by T & T on SAMS's word. He even admitted in court he could not state his sources as to Britney's agreement with him plus as I recall, in reality, he did not speak to her. The "lucid" coment came to him via the "sources". When someone is mentally ill and cannot take care of themselves or make rational, sound decisions, someone has to do that for the person until they get well. In Britney's case, she clearly has been making impulsive, rash decisions for a while. She very badly needs help or she will end up dead. Plain as that. She also needs her assets protected while she is unable to do that herself. So someone is doing just that. Making sure the Sams of the world are not ripping her off and that her bills are paid etc.

When someone is mentally ill, they often refuse medication because they don't think they ARE mentally ill. Once she gets the meds into her and the fog lifts, she will start to see how sick she has been and will hopefully take the meds voluntarily and willfully. She will hopefully continue treatment at a good facility and come out functional, happy, and no longer tormented.

I don't see anything as force. I hope she will start to feel better and then regain control of her life.

They need to keep the bitch medicated. She more than likely flashing her private body parts to everyone in there. She can't go to the gas station, or drive around talking to paps in her british accent. They need to medicate her and give her some serious therapy.

Yes, I think Brit has a long road ahead. I think she needs to be given to be given the time and space to learn who she is as a person. She's likely been told her whole life my her family/management who she SHOULD be, and has never had the opportunity to learn who she really is. Talk about an identity crisis! I'm guessing this is the root of her disdain for her parents - they, along with Larry Rudolph, sent her to rehab for issues with drugs and alcohol. And meanwhile, Brit was right - substance abuse wasn't her problem at all. No wonder she doesn't trust them anymore! I hope she can see past this someday and realize they were only trying to help. It just goes to show how little people in North American know about mental illness.

I don't know, but I think Brit's still got a bright future ahead in the music world. To her credit, she's put out an album (all on her own, without the help of management or her parents) that's been getting great reviews from critics. I bought it the day it came out (make fun of me all you want!) and have been listening to it non-stop ever since. The vocals are more processed than Cheez Whiz, but the music is just as good as any of the hits that Gwen or Fergie have put out lately...if you're into that kind of thing.

My hope for Brit is just that she finds inner peace - and the rest will follow. Once she gets over her "control" issues, I hope she sees that some vocal lessons are in need to rein in that voice of hers. From there, she just might have a chance at being a "credible" artist. But I guess one can only dream.

She can help other kids who have talent and want to perform but don't have the means. She can have a show like "American idol" or something to help people who want and have the talent to be in the industry, or she can do just about anything because she has the money. I don't know...if you go to YouTube and search for "Britney Spears" and "live," there's lots of different videos of her actually singing. Sometimes (mostly when she's older) she sounds like a cat in heat - kinda painful to listen to. But when she was younger she had a very unique voice - very powerful and emotional. I think she probably still has the talent - she just needs to learn how to control her "adult" singing voice. And dropping the smoking habit wouldn't hurt!

Britney should forget about a career, and I don't mean that to be hateful. She is very sick and if she were not a celb, she would be labeled permanently disabled and most likely receive disability. She had a great run, but she will never be what she was. Her illness went on too long and I highly doubt she will ever compltely recover. The best thing she could do is concentrate on her family and being a good mom to those kids.

I totally agree with you. But I think the denial part might be coming from the illness. I have cousins who suffer from ADD, Tourette's, Bi-Polar, etc., and a boyfriend who (I think might) suffer from Borderline Personality Disorder, and from what I've learned from reading books and talking with counsellors, the "control issue" part of it is called "counter will." The more you push someone with a mental illness to get help, the more they will dig in their heels. For instance, if I say to my boyfriend (who is 37-years old!), "It's a work night, and it's 11 pm - you should go get ready for bed," he absolutely won't go. Because he thinks I'm "telling him what to do" and "trying to control him." But if I say, "It's a work night, it's 11 pm - do YOU think you should go get ready for bed?" he will go, because he thinks he is in control and it's his decision to make. It's strange, but once I started using different language, suddenly life became a lot easier.

I'm guessing Brit's parents are going to have do the same...

It was so hard to get my grandmother deemed disabled and incompetent, it took over 2 years she got so bad that even her aides refused to come to take care of her and when put in a home for the elders she got arrested that night and brought in for evaluation.. Mental Docs told us to take her home she passed all the evaluation.. at this point I think that money talks,, parents have 8 bulldog attorney and they got everything done so fast.. I'm amazed.. We went to the best docs too. This grams, did not drive did not make food for herself nothing.. All she wanted was a good time.. The docs would not help us, they just told us to lock her up in an insitution and keep her there with tons of anti agression meds,, to the point she had no idea what was going on..
