A Los Angeles judge has dismissed a restraining order filed against the father of the Survivor producer accused of murdering his wife while on vacation in Mexico.

Bruce Beresford-Redman's father David was initially served earlier this month after the manager at Monica Beresford-Redman's West Los Angeles restaurant claimed she was frightened by David, whom she claimed threatened her with a gun.

Today, Bruce's sister spoke to the press after the hearing was over, saying, "The judge ruled that there was no basis for for a restraining order," and that it was initially "based on a accusations that had absolutely no ground in fact."

As for David, he says, "Obviously I’m very relieved that this has been dismissed. I did not realize the seriousness of a restraining order, it would have branded me as a criminal and I’ve never been a criminal before."

When asked about Bruce's kids, David said, "They're just fine. Theyr’e very happy to be with their father and their wife and I."

We asked if the kids are aware of what's going on, and David responded, "They’re 3 and five, they’re rather young."

His son, Bruce Beresford-Redman, is awaiting extradition to Mexico, where he's currently under arrest for the murder of his wife on April 5th.
