You may think Madonna has more claim to the name Material Girl than anyone, but apparently a clothing company owned by LA Triumph used the name for their clothing line before Madonna did and they want the Material Girl to cease and desist!

An attorney for LA Triumph, Peter Afrasiabi, told X17online in a statement: "Our client and its predecessor have been continually selling similar clothes in similar retail outlets at similar price points under their Material Girl brand since at least 1997 and Madonna and her new-found company do not have the right to trade in the same space under this brand."

"As a result of their acts, our client faces a risk of being subsumed by Madonna's profile, obvious worldwide notoriety and the massive spending campaign by Madonna, her company and retailers on her behalf," said Chris Arledge, another intellectual property lawyer on the case at One LLP.

The suit claims ads for Madonna's line are "risque" and could confuse the public as to the which Material Girl clothing line the commercials represent. The lawsuit also states Macy's will be added as a defendant upon further discovery.

The filing demands "actual damages" in addition to "profits attributable to their unlawful conduct according to proof to be proved at trial."
