Lindsay Lohan is set to appear in court tomorrow before Judge Elden Fox for a probation violation hearing, and though the troubled starlet has spent the past month in rehab at Betty Ford Center, she may not be off the hook as far as the legal system is concerned.

It's been reported that Judge Fox may throw the 24-year-old actress back in jail for up to a year for failing a court mandated drug test last month, but if her lawyers are able to prove that she is making progress in rehab, she may be able to avoid time behind bars. Lohan could also receive a combination of jail time and an extended stay in the treatment facility, and the less likely scenario is that Lohan's hearing would be postponed and she would be allowed to continue her current rehab program.

Judge Fox sentenced Lohan to 30 days in jail on September 24 for violating her probation, but Judge Patricia Schnegg threw out his ruling and set Lohan's bail at $300,000 just a few hours after she was locked up at Lynwood Correctional Facility. On September 26, Lohan went to the Dream Center in LA where she volunteered her time with less fortunate inner city folks, and on September 28 she checked in to Betty Ford, where she has been ever since.
