Judge Elden Fox was probably not too pleased to hear news of Lindsay Lohan's alleged assault of Betty Ford Center employee Dawn Holland, but could he throw the book at Lohan for possibly having violated her probation?

The troubled starlet is set to leave Betty Ford January 3, but when she appears in court to face Judge Fox at her February 25 hearing things could get complicated. We spoke with Criminal Defense Attorney Barry Gerald Sands who tells X17online:

    "The Betty Ford tech reportedly wants to prosecute. If she files criminal charges against Lindsay, that could very well be a violation of her probation in Los Angeles court, which could result in jail time. Judge Elden Fox ordered Lindsay to stay in the Betty Ford center until January and because she has a probation violation already, it is up to Judge Fox to decide to give her another chance. If the staffer files criminal charges this will most definitely complicate her probation."


This isn't good news for Linds! If charges are filed, Judge Fox could order Lohan to serve up to 180 days in jail! Lohan has already spent almost three months at the center working hard on her sobriety and she only has two weeks left! It would be such a shame to see it all thrown away over an argument.

Of course, if Lindsay's dad Michael is right and it was the Betty Ford staffer who b*tch slapped Lindsay first and Lindsay presses charges, Lohan may be able to get out of any trouble with Judge Fox. It's still a somewhat she-says/she-says situation but no doubt some other staffers and perhaps some patients will come forward in each ladies' defense!
