lindsaypleabargainnew.jpgActress Lindsay Lohan has a smart attorney in Shawn Holley - the two women have worked out a defense against the prosecution in the case of the Komofie & Co. stolen necklace.

Holley intends to argue that necklace in question, priced at $2,500 at the Venice jewelry store, has a "fair market value" of approximately $950, making this a petty theft case instead of grand theft.

Under those terms, Lindsay should only receive a misdemeanor charge (not a felony) which is punishable by six months in jail (and not a year).

A source close to Lindsay tells X17 the following:

    "Lindsay's going to accept a plea bargain. She's waiting to try and get the charges reduced to a misdemeanor. She just made the decision last night."


Will this defense strategy work? As Holley has previously stated, she only wants "no jail" for her client so LiLo "can move forward with her recovery and her career."
