Michael Lohan was attacked by his own cell phone yesterday afternoon while being driven home in a convertible.

Lohan told us he got the gash by a faulty phone, but when he got the bleeding under control, he told us he was feeling very good about Lindsay's chances in her felony theft case.

"Lindsay's got a great lawyer, she's got proof and she's got a good judge," Lohan said optimistically.

Lindsay posted bail after her February 11th hearing, but is due back in court on the 23rd, where it's expected she will enter a plea bargain for a misdemeanor.

Although at $2,500, the theft of the necklace is considered a felony, but both her attorneys and her father believe that price is grossly inflated.

In fact, Lohan thinks the price was intentionally adjusted by the store for publicity.

According to Michael, someone who saw the necklace in the store before Lindsay was accused of swiping it came forward to say the pricetag was actually $800, not $2,500, which would be a misdemeanor.

If convicted of a felony, Lindsay could serve up to three years in jail.
