Just hours after Christina Aguilera was released from the West Hollywood Sheriff's station, ex-husband Jordan Bratman took 2-year-old son Max to a local park near his Santa Monica home.
As for whether Bratman will be able to keep Xtina's recently arrested beau Matthew Rutler from seeing his son, custody specialist Michael Kelly tells us:
- "Courts do not ban the birth person's significant other from seeing the child. However, the other parent can order 'no alcohol or drugs for 24 hours' before the parent in question or her boyfriend sees the child."
Video coming soon of Jordan and Max.
Find out what else our legal expert told us about Christina's custody of Max ... after the jump.
- "Fortunately for Christina Aguilera, she wasn't driving. The event had nothing to do with the child. The child wasn't present. There was no innate nor overt behavior reflecting on her parenting abilities."
Courts do not ban the birth person's significant other from seeing the child. However, the other parent can order 'no alcohol or drugs for 24 hours' before the parent in question or her boyfriend sees the child.
There is no chance this incident will affect the custodial litigation in this case. There has to be a significant trend of behavior indicating the parent is a bad caregiver. One bad night out isn't going to change anything."
