xtinapic230WMpic.jpgThe West Hollywood Sheriff's Department says singer Christina Aguilera is no longer in custody at the WeHo station after she and boyfriend Matthew Rutler were arrested at 2:45am during a traffic stop in the 1100 block of Clark Street.

Rutler, however, is still in custody and his bail has been downgraded from $30,000 to $5,000.

A sheriff's spokesperson tells X17online:

    "Christina wasn't kept in custody because she did not commit a crime. She was basically held for welfare purposes which basically means for her own safety."


According to the Sheriff's Department, Rutler was found to be under the influence and arrested on the spot. Aguilera was a passenger in the car.

During a press conference, Steve Whitmore addressed Aguilera's condition. He says:

    "She was not capable of taking care of herself. She was not belligerent."


Whitmore says Xtina was booked, fingerprinted, and put in a cell until "her head clears." He says the singer was released at 7:30am.

As for Rutler, he was pulled over initially for "driving eratically." Whitmore says Rutler's mugshot will be released soon. However Aguilera's won't be released because in her case, "there was no intent to commit a crime."
