Before her court appearance Thursday morning, Lindsay Lohan gave an interview to Life & Style and was adamant about not wanting to go back to jail. She said:

    "Jail is a scary place. I don't wish on anyone."


Lindsay, who served a few weeks in jail in 2010 for violating her probation, got her non-wish. Thursday morning an LA judge ruled that Lindsay testing positive for alcohol consumption was not in violation of her probation. Lindsay's lawyer, Shawn Chapman Holley, explained that Lindsay's court-mandated drug testing ended in February, and that even then it was solely for controlled substances, not alcohol.

But, Holley walked away from reporters when asked about the fact that Lindsay had been adamant that alcohol was "not a part" of her life. "Alcohol is not in my house," she had said.

When asked about a rooftop party Lindsay threw at her Venice Beach home, where she is under house arrest, she insisted that it was a barbecue -- not a party. Lindsay said:

    "I'm doing what I was told to do. People can can say whatever they want, but as far as I'm concerned, I'm doing the right thing."


Holley told reporters at the courthouse Thursday that she felt Lindsay was being subjected to too much for her crimes.
