lohan-court-2013.jpgLindsay Lohan was due to appear in Manhattan Criminal Court today to face a misdemeanor assault charge for allegedly punching psychic Tiffany Mitchell at N.Y.C. club Avenue on November 29, but prosecutors announced they weren’t ready to charge Lohan with anything.

According to Lohan's attorney Mark Heller, the defense team has since drawn up some "very credible evidence and testimony" that would weaken Mitchell's case, including a statement from a witness that Lohan "did absolutely nothing wrong [and] had made no contact with the alleged victim."

“It was not [Lindsay's] intention to get into any type of an aggressive situation,” Heller told reporters outside the courthouse. “She was relaxing and she was literally accosted by various individuals who were pursuing her to read her fortune and to take pictures of her and she politely asked to be left alone." Heller noted that it was Mitchell and her entourage who “became very aggressive."

"It may very well be this case does not move forward...ironically a psychic fortune teller has predicted the year 2013 will be an extremely lucky year for Lindsay Lohan," Heller added.

Lohan will not be required in court for the psychic assault case until formal papers have been filed.
