We are getting really sick of this story ... Can't these two just try to put their differences aside for their kids?!

On Tuesday, a New York judge ordered former Gossip Girl actress to return her two children Hermes, 8, and daughter Helena, 6, back to their father in Monaco.

The 46-year-old was forced to send her children off to thee airport with their paternal grandmother. The order comes after Rutherford refused to send her children back to their father, German businessman Daniel Giersch, last week. On Friday, the actress released a statement saying she had no plans to let her children leave United States, arguing that both California and New York courts both said they don't have jurisdiction over the matter so there's no US state who can force her to return the children.

But a judge clearly didn't agree with her rationale. Both Rutherford and Giersch's legal teams appeared at the Manhattan Supreme Court this morning. Apparently the sides couldn't even agree on whether or not the children should be present for the hearing. Us Weekly says that Rutherford was late and did not bring the children, which upset the judge. However, the children were close by and after the ruling were handed off promptly.

We're glad that these parents are using their children as ping pong balls instead of letting them be kids.
