Selena Gomez's alleged stalker, Thomas Broadnicki, 46, was freed from jail yesterday, but he's back in custody on a psychiatric hold due to growing concern that he may try to hurt the starlet.

Broadnicki was released after a judge dismissed the stalking case, claiming there was not enough evidence that he intended to harm the actress. However, mental health workers told authorities that Broadnicki had threatened to kill Gomez during a therapy session, so it seems as though the starlet does have reason to be concerned. Additionally, Gomez wrote in a sworn declaration that she is in "extreme fear" of Brodnicki.

A source tell E! News that Broadnicki is currently being evaluated to "determine whether he should continue to be confined at an undisclosed mental health facility." The state of California can legally hold him against his will for the next 72 hours while doctors examine him.

A civil restraining order requires Brodnicki to stay 100 yards away from Gomez, and a hearing is set for November 23 to determine whether the order will remain in place for the next three years.

Demi Moore just announced that she was ending her 6-year marriage to Ashton Kutcher, and now the Two and a Half Men star has released his own statement on their split.

Ashton tweeted:

The 49-year-old actress tells the Associated Press that she came to this decision with "great sadness and a heavy heart."

Moore, who has appeared extremely thin in recent weeks, added, "as a woman, a mother and a wife, there are certain values and vows that I hold sacred, and it is in this spirit that I have chosen to move forward with my life."

Moore and Kutcher, 33, tied the knot in September 2005.

Their marriage has been on shaky ground since reports surfaced months ago that 22-year-old Sara Leal had an affair with the actor.

Michael Lohan pleaded no contest to domestic violence charges in Florida, and as a result, Lindsay's dad avoided jail time. Papa Lohan was accused of beating ex girlfriend Kate Major back in October.

Lohan, 51, was sent to rehab for four months and was ordered to enter into a domestic violence intervention program in Tampa.

In court, Major, 29, told the judge, "I think he needs help. Keeping him in jail would be hurting him more. It's my birthday today. A year ago, we were worried about Lindsay."

The judge replied, "I'm not sure who that is." Ouch!

After Michael Lohan was told he could have "zero" contact with Major, the judge witnessed Lohan making faces. The judge told Lohan, "It's not Disney World, so stop. How old are you? Don't act like a child."
