Lindsay Lohan will surrender herself to court during her scheduled appearance Tuesday.

Earlier today, attorney Robert Shapiro told X17online that he would be repping Lindsay Lohan "on the condition that she complies with all of the terms of her probation, including a requirement of jail time that was imposed by Judge Marsha Revel."

And just this afternoon, he told X17online that Lindsay, who's been spending the last several nights in Shapiro's sober living facility, Pickford Lofts, will not come out until she has to go to court on Tuesday:

"She's not gonna come out -- I will tell you that without question -- until Tuesday when she goes to court," he said.

Other celebrities have turned themselves in earlier than their appointed deadline in the past in an attempt to dodge the media, but it seems as if Lindsay will be waiting until the last possible moment to turn herself in.

Although cameras will be allowed inside during her scheduled hearing, they will be turned off as soon as Lindsay is handcuffed and carted away to jail.

Shapiro's statement alluded to Lindsay "suffering from a disease that I am all too familiar with," referencing the loss of his son to addiction in 2005. Lindsay has been quick to deny having a drug or alcohol problem in the past -- has she finally 'fessed up to the truth? Or was this another condition of his taking her case -- her admitting that she has a problem?

Hopefully Lindsay's finally in a place of acceptance about her fate and her issues, and really will find peace throughout this ordeal.

Today while returning to Pickford Lofts to spend more time with her daughter Lindsay, an X17online photographer asked Dina Lohan if she thought Lindz could avoid jail time now that she's hired powerhouse attorney Robert Shapiro.

Dina kept her mouth shut on any of Lindsay's legal woes, but she lit up when we paid her a compliment!

"You look like a California girl," our photog said, putting a smile on Dina's face. "Oh, gosh," she said laughing, before making it clear that she may be a blonde but she's a New Yorker at heart.

I guess her sunny disposition and hard New York sensibilities will help her through this troubled time!

Attorney Robert Shapiro has ended days of speculation and confirmed to X17online that he is indeed repping Lindsay Lohan, who's been staying at his sober living facility, Pickford Lofts, for the past several days.

In a statement, Shapiro said,

“I have agreed to represent Ms. Lohan on the condition that she complies with all of the terms of her probation, including a requirement of jail time that was imposed by Judge Marsha Revel.  

Ms. Lohan is suffering from a disease that I am all too familiar with.  

Hopefully, I can be of assistance to Ms. Lohan and Judge Revel in implementing a treatment approach recommended by medical professionals for Ms. Lohan’s long term recovery and sobriety.”

Lindsay has been in legal limbo since her former attorney, Shawn Chapman Holley, quit her case after Lindsay received a 90 day jail sentence.
