We're hearing now that Britney's attorney, Anne Kiley, is asking to withdraw after today's hearing, and will be replaced by celebrity divorce attorney Stacy Phillips, who represented Bobby Brown in his divorce from Whitney.

But before she goes, Kiley has taken a swipe at Kaplan himself, and his public persona. In response to his argument against the gag order, Kiley says:

"The first amendment rights aren't absolute. We aren't trying to control the paparazzi, we are trying to control what we can control. We've heard nothing from the respondent (Kaplan) in his papers or arguments as to why it is that attorneys need to make statements to the media."


It seems that custody isn't the only thing on the menu for today's hearing!
